1-Day Repair Guarantee — Terms & Conditions

• Repair in One Business Day: If we pre-qualify your vehicle and start work, we commit to finishing eligible hail-dent repairs within one (1) business day after we take possession.

• Eligibility Matters: The guarantee applies only to hail damage that is truly Paintless Dent Repair (PDR)-ready and to vehicles we have expressly confirmed as “1-Day Repair” eligible.
  
• Common Exclusions: Non-PDR damage, weather or safety issues, parts shortages, insurance delays, or any customer-caused hold-ups pause or void the timeline.
• ‍Using Our Services = Accepting These Terms: By requesting an estimate, booking service, or allowing us to work on your vehicle, you agree to everything below.

1. About These Terms

These Terms & Conditions (“Terms”) set out the legally binding rules for Hail Butlers Texas LLC’s “Repair in a Day or You Don’t Pay Out-of-Pocket” guarantee (“1-Day Guarantee”). They supplement— and, where timing is concerned, supersede—any other agreement you may have with us.

How You Accept

You accept these Terms by any of the following:

1. submitting an online estimate or service request;
   
2. scheduling an appointment (online, by phone, text, or in person); or
   
3. allowing us to take possession of your vehicle for repair.
   

If you do not agree, do not request or use our services.

2. Definitions

“Business Day” — Monday through Friday, excluding U.S. federal and Texas state holidays.
“Completion” — our written confirmation that all agreed hail dents have been repaired and your vehicle is reassembled.
“Extreme Weather” — severe storms, heavy precipitation, freezing temps, or other unsafe outdoor conditions that materially hinder mobile PDR work.
“Qualifying Damage” — hail dents repairable by PDR without paint, structural work, part replacement, or glass work.
“Take Possession” — the date and time we gain continuous, physical custody of your vehicle at the agreed worksite.

3. Eligibility Requirements

To activate the 1-Day Guarantee, all of the following must be true:

4. Scope of the Guarantee

• Timeline Commitment. We will complete Qualifying Damage repairs within one (1) Business Day after we Take Possession, subject to Sections 5 & 6.
• ‍Quality Still Covered Elsewhere. Our workmanship warranty—found in our general Service Terms—covers quality. This section concerns timing only.

5. Exclusions, Pauses, and Voids

The 1-Day clock pauses or the guarantee does not apply when:

1. Non-PDR Damage discovered during disassembly (e.g., cracked paint, structural issues).
   
2. Customer-Caused Delays such as restricted access, rescheduling, or withheld approvals.
   
3. Extreme Weather / Safety Issues or site restrictions imposed by landlords, HOAs, or local ordinances.
   
4. Parts / Glass Needed and those items are unavailable at the start of work.
   
5. Insurance Delays including re-inspection, supplemental approvals, or payment disputes.
   
6. Force Majeure — events beyond our reasonable control (e.g., natural disasters, civil authority orders).
   
   

Each paused day adds a day to the deadline. If exclusions make one-day completion impossible, we will proceed only with your consent under a revised schedule (the guarantee no longer applies).

6. Commencement & Calculation of the 1-Day Period

1. Start Time — The clock starts at the later of (a) 8:00 a.m. local time on the scheduled Business Day or (b) the moment we Take Possession.
   
2. Partial-Day Start — If we start mid-day, the deadline is that same clock-time on the next Business Day.

7. Our “No Out-of-Pocket” Promise

7.1 What We Waive

If and only if we miss the extended deadline solely due to our own delay, we will waive your direct out-of-pocket payment to us for those specific hail repairs (e.g., deductible, deposit, or co-pay).

7.2 What We Do Not Waive

• Insurance proceeds owed or paid to us remain ours unless Texas law says otherwise.
  
• We do not refund or credit any insurer payments.
• If a delay is partly your fault or falls under any exclusion, we may offset or decline the waiver.

8. Insurance Disclosures

• We are not an insurance company or public adjuster. We simply help with paperwork.
• Your insurer decides claim approval and payment.
• Misrepresenting or withholding claim funds voids this guarantee and may constitute insurance fraud.

9. Dispute Resolution; Governing Law

1. Mediation First. Any dispute must start with non-binding mediation in Collin County, Texas (or the Texas county where our principal office is then located).
   
2. Litigation Venue. If mediation fails within 30 days, either party may sue in the state or federal courts of that county.‍
3. Fees. The prevailing party may recover reasonable attorneys’ fees and costs.
4. ‍Governing Law. Texas law (without regard to conflict-of-law rules) governs these Terms.

10. Limited Liability

To the fullest extent permitted by Texas law, Hail Butlers Texas LLC is not liable for indirect, incidental, special, or consequential damages arising from or related to the 1-Day Guarantee. Our total liability is capped at the amount you (or your insurer) actually paid to us for the qualifying repair.

11. Changes to These Terms

We may modify these Terms at any time. Updated versions will be posted at the same URL with a new “Last updated” date. Continued use of our services after changes means you accept the new Terms.
